Here is a summary of forthcoming legislation that could affect you and your company...

Legislation/Regulation
Date to be
Implemented

Brief Description
Immigration (Restrictions on Employment) Order 2007 - ID cards evidence of right to work in the UK

24 November 2009
The Order adds ID cards to the list of documents that employers can accept as evidence of the right to work. Employers must ensure that both sides of the card have been copied for retention purposes.

Education (School Teachers’ Qualifications) (England) (Amendment) Regulations 2009

1 January 2010
Amendments include preventing overseas trained teachers from being awarded qualified teacher status (QTS) in England as a result of their recognition as a teacher in Scotland or Northern Ireland, without having taught in these countries; and allowing trainee teachers working in British service schools abroad to be awarded QTS on the strength of their teaching experience in those schools.

The Work and Families Act 2006 - Paternity Leave and Pay
April 2010
Legislation is intended to come into force in April 2010, which will affect parents of babies due from 3 April 2011.

Fathers will be able to take up to 26 weeks' additional paternity leave where the mother returns to work before the end of her maternity leave entitlement. This will be available during the second six months of the child's life and may be paid if taken during the mother's statutory maternity pay period.
Right to request time off for training
April 2010
The Government intends to introduce the right to time off to train for employees in organisations with 250 or more employees in April 2010, with the legislation being extended to cover all employees from April 2011.

The right is to be modelled on the existing right to request flexible working.  Employers will be obliged to consider requests seriously, but will be able to refuse a request where there is a good business reason for doing so.  Employers will not be obliged to meet the salary or training costs to enable a request to be met.

Employment Relations Act 1999 – Blacklisting for Union Membership or activities is prohibited
Early 2010
The blacklisting of workers from employment as a result of their union membership or activities will be prevented when this is introduced in early 2010.
