BIS has published
guidance on the new right to request time off to train that will come into effect for employers with 250 or more employees in April 2010 and all other employers in April 2011. The right is modelled on the right to request flexible working in that employers will be able to turn down requests where they can objectively justify that the business cannot accommodate it. Only employees with 26 weeks or more service can make a request. Time off, if granted, need not be paid. Further employer guidance is promised for January 2010 and will be published on the Business Link website.
