Government Toughens Up National Minimum Wage Law
The DTI has announced new regulations to toughen up the enforcement of the National Minimum Wage (NMW). The new rules that came into force on 8th July 2003 will ensure that workers can claim arrears for past as well as current employment.
Deficiency Notices
The first tranche of letters under a pilot scheme has been sent out to approximately 5000 people informing them about the gaps in their National Insurance Contributions between 6th April 1996 and 5th April 2002. These are the famous Deficiency Notices that were widely covered in the press earlier this year when it was revealed that they had not been issued since 1996 because of problems with NIRS2.
New Plans to Force Employers to Consult with Employees
Earlier this year, the DTI announced the Government plans for improved information and consultation in the workplace. The Government has agreed a framework for implementing a European Directive on employment law with both the CBI and TUC.

CIPD carries out survey on Training and Development needs in the UK
In a recent survey carried out by the CIPD, it was revealed that over 40% of managers feel they need more training, but that time pressure and other constraints hindered this occurring. The survey is conducted annually, using 500 managers from a variety of sectors and shows the changing requirements and understanding of training and management needs.

CIPD welcomes Government Taskforce Report on Human Capital
The CIPD welcomes the government to endorse the recommendations set out in the Accounting for People report. The CIPD would favour the government to follow the recommendations for companies to report on their approach to human capital management. However, it should not adopt a prescriptive set of measures but be a flexible and evolutionary approach based on “general principles to guide decisions”.

VAT Recovery - fuel purchased by employees
Following a challenge by the European Courts on the treatment and VAT recovery by employers on fuel purchased by their employees, new secondary legislation has been introduced, specifically by repealing the Value Added Tax (Input Tax) (Person Supplied) Order 1991 and replacing it with a new Order to be known as the Value Added Tax (Input Tax) (Road Fuel Purchased By Employees) (Order) 2005.

PAYE and NICs alignment
The Chancellor announced in his budget speech, that a consultation will take place later in the year to consult on the complexities of National Insurance compared to the legislation surrounding income tax.
Low Pay Commission report (LPC)
The Chancellor has accepted the LPC report which can be found on the above website address.
Bank holidays
Although the LPC has made reference to the possible extension to statutory leave entitlement to include bank holidays (8) to the existing 20 days leave, the Government has not announced an implementation date or indicated whether it will be staged.
Computer Schemes
In the main body of the budget report is one small paragraph that was not expected, in respect of computers on loan to employees.
Mobile phones
The budget report also states that the tax exemption on mobile phones is also refocused to deliver on the objectives, by only allowing one mobile phone available for private use tax-free per employee.
Company Car tax
The minimum charge rate for calculating benefit in kind for company cars will be reduced from 140g per kilometre to 135g per kilometre from 2008- 09.
VDU users, eye tests and glasses
Currently employers are required by law to provide, or meet the cost of, eyecare tests and/or corrective glasses for VDU use for their employees.
Lord Carter report
There were no real surprises here. Lord Carter has recommended that all UK businesses that are 'IT literate' should be corresponding with HMRC electronically by 2012.
How HMRC is working to make life easier for business
In 2005 a consultation was launched which set out the vision of the service that HMRC aspired to provide for small businesses and sought their views on how best to capture the benefits, of the merger with Customs and Excise, to reduce the administrative burdens posed by the tax system.

In a recent High Court judgement, HMRC v Thorn Baker Ltd, the Court found in favour of Thorn Baker who had not paid SSP to a fixed term temporary agency worker whose contract was less than 3 months.
Age discrimination
The new regulations protect employees from discrimination and harassment on the grounds of age. They also introduce a national default retirement age of 65.
Fixed Term Contracts can now become permanent
We are now at the four year point where, for the first time, fixed-term contracts can become permanent. This is set out in the Fixed-Term Employees (Prevention of Less Favourable Treatment) Regulations 2002 SI 2002/2034

New National Minimum Wage rates apply to reference periods commencing on or after 01 October 2006.
